1. Agreement to Terms
By accessing and using Aris Academy (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
Aris Academy is operated by Aris Academy Pty Ltd (ABN: 42 694 683 694), a company registered in New South Wales, Australia ("we", "us", "our").
2. Description of Service
Aris Academy provides an online educational platform offering:
- AI-powered writing feedback and assessment tools
- Practice questions and exercises for NSW Selective High School Test preparation
- Educational resources and learning materials
- Progress tracking and performance analytics
The Service is designed to supplement, not replace, formal education and tutoring.
3. Eligibility and Account Registration
To use certain features of the Service, you must register for an account. By registering, you represent that:
- If you are under 18 years of age, you have the consent of a parent or guardian to use the Service
- All registration information you provide is accurate and complete
- You will maintain the accuracy of such information
- You are responsible for maintaining the confidentiality of your account credentials
Parents or guardians who register on behalf of a minor accept these Terms on their behalf and are responsible for their use of the Service.
4. Subscription and Payment
4.1 Pricing
Some features of the Service require a paid subscription. Current pricing is displayed on our Pricing page. All prices are in Australian Dollars (AUD) and include GST where applicable.
4.2 Billing
Subscriptions are billed in advance on a recurring basis (weekly, monthly, or as specified at purchase). Your subscription will automatically renew unless cancelled before the next billing cycle.
4.3 Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation:
- You will retain access to paid features until the end of your current billing period
- No refunds will be provided for partial billing periods
- Your account will revert to free-tier access after the billing period ends
5. Consumer Guarantees
Nothing in these Terms is intended to exclude, restrict or modify rights you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) which cannot be excluded, restricted or modified by agreement.
If you are a "consumer" as defined under the Australian Consumer Law:
- Our services come with guarantees that cannot be excluded under the Australian Consumer Law
- You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage
- You are also entitled to have the services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure
6. Refund Policy
We offer refunds in accordance with Australian Consumer Law:
- Major failures: If there is a major failure with our Service, you are entitled to cancel your subscription and receive a refund for any unused portion
- Minor failures: If there is a minor failure, we will remedy the issue within a reasonable time. If we fail to do so, you may be entitled to a refund
- Change of mind: We do not offer refunds for change of mind, except where required by law

7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Share your account credentials with others or allow multiple people to use a single account
- Copy, reproduce, distribute or create derivative works from our content without permission
- Attempt to reverse engineer, decompile or hack the Service
- Use automated systems (bots, scrapers) to access the Service
- Submit content that is defamatory, obscene, or infringes on intellectual property rights
- Interfere with or disrupt the Service or servers
- Misrepresent your identity or affiliation
8. User Content
When you submit written responses or other content to the Service ("User Content"):
- You retain ownership of your User Content
- You grant us a non-exclusive, royalty-free licence to use, store, and process your User Content to provide the Service and improve our AI systems
- We may anonymise and aggregate User Content for research and service improvement purposes
- You represent that you have the right to submit the User Content and that it does not infringe any third party rights
9. Intellectual Property
All content, features, and functionality of the Service (including but not limited to text, graphics, logos, practice questions, and software) are owned by Aris Academy or our licensors and are protected by Australian and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify or create derivative works from any materials on the Service without our prior written consent.
10. AI-Generated Feedback Disclaimer
Our Service uses artificial intelligence to provide writing feedback and assessments. You acknowledge that:
- AI-generated feedback is provided for educational purposes only and should not be considered as the sole measure of writing ability
- AI assessments may not perfectly align with official NSW Selective Test marking
- We continuously work to improve accuracy but cannot guarantee error-free feedback
- The Service is a supplementary learning tool and should be used alongside other preparation methods
11. Limitation of Liability
To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law:
- We are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service
- Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months prior to the claim
- We do not guarantee any particular exam results or outcomes
12. Indemnification
You agree to indemnify and hold harmless Aris Academy and its officers, directors, employees and agents from any claims, damages, losses, liabilities, costs and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your User Content
13. Service Availability
We strive to provide uninterrupted access to the Service but do not guarantee that the Service will be available at all times. We may:
- Perform maintenance that may temporarily affect availability
- Modify, suspend or discontinue features with reasonable notice where practicable
- Experience downtime due to factors beyond our reasonable control
14. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information.
15. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms on this page with a new "Last Updated" date
- Sending an email notification for significant changes
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
16. Termination
We may suspend or terminate your account if you breach these Terms. Upon termination:
- Your right to access the Service ceases immediately
- Provisions that by their nature should survive termination will survive (including intellectual property, limitation of liability, and dispute resolution provisions)
17. Governing Law and Disputes
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Service shall be:
- First, attempted to be resolved through good faith negotiation
- If negotiation fails, submitted to mediation in Sydney, NSW
- If mediation fails, subject to the exclusive jurisdiction of the courts of New South Wales
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aris Academy regarding the Service and supersede any prior agreements.
